4. Enforcement Procedure (نفاذ کا طریقۂ کار):
(1) Authorized officer (مجاز افسر) اپنے دائرہ اختیار کے کسی بھی علاقے میں کسی بھی motor vehicle (موٹر گاڑی) یا class of motor vehicles (موٹر گاڑیوں کی کسی جماعت) کا معائنہ، جانچ یا چیک کسی بھی وقت کر سکتا ہے۔
(2) Authorized officer (مجاز افسر) motor vehicle (موٹر گاڑی) کا معائنہ calibrated instrument (مرتبہ شدہ آلہ) کے ذریعے کرے گا تاکہ environmental quality standards (ماحولیاتی معیار) کے مطابق vehicular emissions (گاڑیوں سے خارج ہونے والے اخراج)، exhaust (دھواں)، noise (شور)، vibration (ارتعاش) اور smoke (دھواں) کی جانچ کی جا سکے۔ یہ معائنہ motor vehicle (موٹر گاڑی) کے owner (مالک) کی موجودگی میں موقع پر ہی کیا جائے گا تاکہ air pollutants (فضائی آلودگی پیدا کرنے والے ذرات) کا تعین کیا جا سکے۔
(3) اگر motor vehicle (موٹر گاڑی) ماحولیاتی معیار پر پوری نہیں اترتی تو authorized officer (مجاز افسر) Act (ایکٹ) کے Section 15 (سیکشن 15) کی Subsection (2) (ذیلی شق 2) کے مطابق direction (ہدایت) جاری کرے گا جو owner (مالک) کے نام پر ہوگی۔
(4) Authorized officer (مجاز افسر) ایک تاریخ مقرر کرے گا جو سات دن سے زیادہ نہ ہو، اور اس جگہ کا تعین کرے گا جہاں motor vehicle (موٹر گاڑی) کا دوبارہ معائنہ (re-inspection) کیا جائے گا تاکہ ہدایت کی تعمیل (compliance) کو جانچا جا سکے۔
(5) Authorized officer (مجاز افسر) motor vehicle (موٹر گاڑی) کے registration book (رجسٹریشن بُک)، driving licence (ڈرائیونگ لائسنس) یا computerized national identity card (کمپیوٹرائزڈ قومی شناختی کارڈ) کو اپنی تحویل میں لے سکتا ہے اور direction slip (ہدایت پرچی) پر ان دستاویزات کی تفصیل درج کرے گا۔
(6) Authorized officer (مجاز افسر) ان تحویل شدہ دستاویزات کی حفاظت، معیار اور مقدار کا ذمہ دار ہوگا اور جب بھی عدالت میں ان کی ضرورت ہو، وہ انہیں پیش کرے گا۔
(7) Authorized officer (مجاز افسر) وہ uniform (وردی) پہنے گا جو Government (حکومت) کی طرف سے نوٹیفائی کی گئی ہو، اور ان قواعد کے تحت اپنے فرائض کی انجام دہی میں وہ duty vehicle (ڈیوٹی گاڑی) پر revolving green light (گردشی سبز بتی) استعمال کر سکتا ہے۔ مزید یہ کہ وہ local or traffic police (مقامی یا ٹریفک پولیس)، transport authorities (ٹرانسپورٹ اتھارٹیز) یا district administration (ضلعی انتظامیہ) کی مدد بھی حاصل کر سکتا ہے۔
(8) Authorized officer (مجاز افسر) ایک daily diary register (یومیہ ڈائری رجسٹر) رکھے گا جس میں motor vehicles (موٹر گاڑیوں) کے معائنے کی تفصیلات، owners (مالکان) کے کوائف، instruments (آلات) کی تفصیل جن سے air pollutants (فضائی آلودگی) اور noise (شور) کا تعین کیا گیا، نیز کسی violation (خلاف ورزی) یا شواہد جمع کرنے کی تفصیل درج ہوگی۔
(9) Authorized officer (مجاز افسر) motor vehicle (موٹر گاڑی) کے owner (مالک) کو دی گئی directions (ہدایتوں) کی تعمیل کی جانچ کرے گا، اور اگر ہدایت:
(a) پوری کر دی گئی ہو، تو وہ تعمیل کی ایک inventory (فہرست) تیار کرے گا اور تمام retained documents (تحویل شدہ دستاویزات) owner (مالک) یا اس شخص کو واپس کرے گا جو ان دستاویزات کا قانونی حقدار ہو۔
(b) پوری نہ کی گئی ہو، تو وہ Schedule-II (شیڈول دوم) کے مطابق تمام retained documents (تحویل شدہ دستاویزات) کی inventory (فہرست) بنائے گا اور Administrative Penalty Rules (انتظامی جرمانہ قواعد) کے تحت owner (مالک) پر administrative penalty (انتظامی جرمانہ) عائد کر سکتا ہے یا Environmental Magistrate (ماحولیاتی مجسٹریٹ) کے سامنے complaint (شکایت) دائر کر سکتا ہے۔
