Rule#1. مختصر عنوان اور آغاز (Short title and commencement):
(1) ان قواعد (Rules) کو پنجاب ماحولیاتی تحفظ (موٹر وہیکل) قواعد، 2013 کہا جائے گا۔(2) یہ قواعد فوراً نافذ العمل (come into force at once) ہوں گے۔
Rule#2 . تعریفات (Definitions):
(1) ان قواعد میں، جب تک مضمون یا سیاق و سباق اس کے برعکس نہ ہو، درج ذیل اصطلاحات (expressions) کے معنی یہ ہوں گے:(الف) “قانون (Act)” سے مراد پنجاب ماحولیاتی تحفظ ایکٹ، 1997 (Punjab Environmental Protection Act, 1997 – XXXIV of 1997) ہے۔
(ب) “انتظامی جرمانہ (administrative penalty)” سے مراد وہ جرمانہ ہے جو دفعہ 17 کی ذیلی دفعہ (7) کے تحت فراہم کیا گیا ہے۔
(ج) “مجاذ افسر (authorized officer)” سے مراد صوبائی ایجنسی (Provincial Agency) کا وہ افسر ہے جسے ڈائریکٹر جنرل (Director General) کی جانب سے موٹر وہیکل کے ضابطے (regulation) کے لیے دفعہ جات 15، 17، 24 اور 25 کے تحت کارروائی کرنے کی اجازت دی گئی ہو۔
(د) “شکایت (complaint)” سے مراد ایسے الزامات کا بیان ہے جو زبانی یا تحریری طور پر ماحولیاتی مجسٹریٹ (Environmental Magistrate) کے سامنے ان قواعد کے تحت کارروائی کے لیے پیش کیا جائے۔
(ہ) “ہدایت (direction)” سے مراد وہ تحریری ہدایت ہے جو مجاز افسر موٹر وہیکل کے مالک کو دیتا ہے تاکہ وہ مخصوص آلودگی کنٹرول آلات (pollution control devices) یا دیگر سامان نصب کرے، مخصوص ایندھن (fuels) استعمال کرے، یا لازمی دیکھ بھال (maintenance) یا جانچ (testing) کروائے، جیسا کہ Schedule-I میں مذکور ہے۔
(و) “خلاف ورزی (offence)” سے مراد ایسا عمل یا کوتاہی ہے جو دفعہ 15 کی خلاف ورزی یا ان قواعد کے تحت صوبائی ایجنسی یا مجاز افسر کی کسی ہدایت یا حکم (order or direction) کی عدم تعمیل (non-compliance) ہو۔
(ز) “مالک (owner)” میں ڈرائیور (driver)، ٹھیکیدار (contractor)، آپریٹر (operator) یا گاڑی کا سوار (occupant) شامل ہے۔
(2) ان قواعد میں استعمال ہونے والے دیگر تمام الفاظ و اصطلاحات جن کی وضاحت یہاں نہیں کی گئی، ان کے معنی وہی ہوں گے جو قانون (Act) میں دیے گئے ہیں
