ماحولیات کے تحفظ سے متعلق پنجاب ایکٹ 1997 (ایکٹ نمبر XXXIV آف 1997) کی دفعہ 31 کے تحت حاصل اختیارات کو استعمال کرتے ہوئے، گورنر پنجاب کو خوشی ہے کہ وہ حسبِ ذیل قواعد وضع کریں:

1. مختصر عنوان اور آغاز:

(1) ان قواعد کو “پنجاب ماحولیاتی تحفظ (موٹر وہیکلز) قواعد 2013″ کہا جائے گا۔
(2) یہ قواعد فی الفور نافذ العمل ہوں گے۔

2. تعریفات:

(1) ان قواعد میں:

(a) “ایکٹ” سے مراد پنجاب ماحولیاتی تحفظ ایکٹ 1997 (ایکٹ نمبر XXXIV آف 1997) ہے۔

(b) “انتظامی جرمانہ” سے مراد وہ جرمانہ ہے جو ایکٹ کی دفعہ 17 کی ذیلی دفعہ (7) کے تحت عائد کیا گیا ہو۔

(c) “مجاز افسر” سے مراد صوبائی ایجنسی کا وہ افسر ہے جسے ڈائریکٹر جنرل کی طرف سے ایکٹ کی دفعات 15، 17، 24 اور 25 کے تحت موٹر گاڑیوں کے ضابطے کے لیے کارروائی کرنے کی اجازت دی گئی ہو۔

(d) “شکایت” سے مراد زبانی یا تحریری طور پر ماحولیاتی مجسٹریٹ کے سامنے وہ بیان ہے جو ان قواعد کے تحت کارروائی کے لیے الزامات پر مشتمل ہو۔

(e) “ہدایت” سے مراد وہ تحریری ہدایت ہے جو مجاز افسر کی طرف سے کسی موٹر گاڑی کے مالک کو جاری کی جائے تاکہ وہ آلودگی کو کنٹرول کرنے والے آلات یا دیگر سازوسامان نصب کرے، مخصوص ایندھن استعمال کرے یا گاڑی کی دیکھ بھال یا جانچ پڑتال کروائے، جیسا کہ شیڈول اوّل میں درج ہدایت نامے (Direction Slip) میں بیان کیا گیا ہو۔

(f) “جرم” سے مراد ایسا فعل یا ترکِ فعل ہے جو ایکٹ کی دفعہ 15 کی خلاف ورزی یا ان قواعد کے تحت صوبائی ایجنسی یا مجاز افسر کی جانب سے جاری کردہ کسی حکم یا ہدایت کی عدم تعمیل پر مشتمل ہو۔

(g) “مالک” میں ڈرائیور، ٹھیکیدار، آپریٹر یا موٹر گاڑی کا سوار شامل ہے۔

(2) وہ تمام الفاظ اور اصطلاحات جو ان قواعد میں استعمال ہوئے ہیں لیکن ان کی تعریف یہاں نہیں دی گئی، ان کے معنی وہی ہوں گے جو ایکٹ میں بیان کیے گئے ہیں۔

3. ممانعت:

کوئی شخص ایسی موٹر گاڑی استعمال نہیں کرے گا جس سے خارج ہونے والی ہوا میں موجود آلودگی یا شور کی مقدار یا سطح ماحولیاتی معیار (Environmental Quality Standards) یا جہاں قابل اطلاق ہو، ایکٹ کی دفعہ 6 کی ذیلی دفعہ (1) کی شق (g) کے تحت قائم کردہ معیار سے زیادہ ہو۔
