قاعدہ 6 – Environmental Approval Committee (ماحولیاتی منظوری کمیٹی)

(1) ہر Division (ڈویژن) کے لیے ایک Committee (کمیٹی) ہوگی، جس کے اراکین یہ ہوں گے:
(a) Commissioner (کمشنر) جو Committee کا Chairperson (چیئرمین) ہوگا؛
(b) Notified Officer (نامزد افسر) جو Committee کا Convener (سربراہِ اجلاس) ہوگا؛
(c) ایک Expert (ماحولیاتی ماہر) جسے Secretary (سیکرٹری) متعلقہ Commissioner کی سفارش پر مقرر کرے گا۔

(2) Committee، Rule 5 کے تحت کیے گئے Review (جائزے) کی روشنی میں Environmental Assessment (ماحولیاتی جانچ) پر غور کرے گی، اور اگر مناسب ہو تو Environmental Approval (ماحولیاتی منظوری) دے سکتی ہے۔

(3) Chairperson کسی بھی شخص کو معلومات یا مشورے کے لیے Meeting (اجلاس) میں بلا سکتا ہے، لیکن ایسے شخص کو Vote (رائے دینے) کا حق نہیں ہوگا۔

(4) Committee عام طور پر مہینے میں ایک بار Meeting کرے گی، تاہم Secretary یا Chairperson جب چاہیں Meeting بلا سکتے ہیں۔

(5) Committee کے تمام فیصلے اکثریتی رائے (Majority Opinion) کی بنیاد پر ہوں گے۔

قاعدہ 7 – Conditions of Approval (منظوری کی شرائط)

(1) ہر Approval (منظوری) Committee کی مقرر کردہ شرائط کے علاوہ اس شرط کے ساتھ ہوگی کہ Project (منصوبہ) کو قانون (Law) کے مطابق Design (ڈیزائن)، Construct (تعمیر)، اور Operate (چلایا) کیا جائے، اور تمام حفاظتی (Protective) اقدامات کیے جائیں۔

(2) Proponent (درخواست دہندہ) کو Project کی تعمیر شروع کرنے سے پہلے ایک Undertaking (تحریری عہد) دینا ہوگا، جو Schedule-II میں دی گئی Form (فارم) کے مطابق ہوگا، تاکہ وہ تمام شرائط کو قبول کرتا ہے۔

(3) Proponent کو Project کے چلانے (Operation) سے پہلے Operational Phase (عملی مرحلے) کی منظوری حاصل کرنی ہوگی اور یہ تصدیق کرنی ہوگی کہ Design، Construction، اور Mitigation (تخفیف و تحفظ) سے متعلق تمام شرائط پوری ہو چکی ہیں۔

قاعدہ 8 – Monitoring (نگرانی)

(1) Commissioner (کمشنر) خود یا Notified Officer (نامزد افسر) کے ذریعے Approval (منظوری) کی شرائط پر عمل درآمد اور Project کی کارکردگی کی باقاعدہ نگرانی کرے گا۔

(2) اس مقصد کے لیے Commissioner یا اس کی اجازت سے Notified Officer، Proponent (درخواست دہندہ) سے ضرورت کے مطابق مخصوص وقفوں پر مطلوبہ Information (معلومات) مانگ سکتا ہے۔
