108۔ بغاوت انگیز مواد پھیلانے والے اشخاص سے نیک چلنی کی ضمانت (Security for Good Behaviour from Persons Disseminating Seditious Matter)
جب کسی پہلی جماعت کے مجسٹریٹ (Magistrate of the First Class) کو یہ اطلاع ملے کہ اُس کے دائرہ اختیار (Jurisdiction) کے اندر کوئی ایسا شخص موجود ہے جو، چاہے اندرونِ حدود یا بیرونِ حدود،
زبانی، تحریری یا کسی بھی دوسرے طریقے سے جان بوجھ کر (Intentionally) پھیلانے (Disseminate) یا پھیلانے کی کوشش کرنے (Attempt to Disseminate) یا کسی طرح اُس کے پھیلاؤ میں مدد (Abet the Dissemination) کرتا ہے —
(a) کوئی بغاوت انگیز مواد (Seditious Matter)، یعنی ایسا مواد جس کی اشاعت تعزیراتِ پاکستان (Pakistan Penal Code) کی دفعہ 123A یا 124A کے تحت قابلِ سزا ہو؛
(b) کوئی ایسا مواد جس کی اشاعت تعزیراتِ پاکستان کی دفعہ 153A کے تحت قابلِ سزا ہو؛
(c) کوئی ایسا مواد جو کسی جج (Judge) سے متعلق ہو اور جو جرمِ دھمکی (Criminal Intimidation) یا ہتکِ عزت (Defamation) کے زمرے میں آتا ہو؛
تو ایسا مجسٹریٹ، اگر اُس کی رائے میں کارروائی کے لیے کافی وجوہات موجود ہوں،
اُس شخص کو حکم دے سکتا ہے کہ وہ یہ وضاحت کرے کہ اُسے کیوں حکم نہ دیا جائے کہ وہ اپنی نیک چلنی (Good Behaviour) کے لیے، ضامنوں کے ساتھ یا بغیر، ایک ضمانت نامہ (Bond) ایک سال تک (زیادہ سے زیادہ) داخل کرے،
جیسا کہ مجسٹریٹ مناسب سمجھے۔
مزید یہ کہ، اس دفعہ کے تحت کسی ایڈیٹر (Editor)، مالک (Proprietor)، پرنٹر (Printer) یا پبلشر (Publisher) کے خلاف کارروائی اُس وقت تک نہیں کی جا سکتی جب تک کہ وہ اشاعت ایسی نہ ہو جو
